Edward Gill< no role > of the Haymarket in the County of Middlesex Prosecutor
in the above Cause Maketh Oath and Saith that the said Defendant was
some time in or about the Month of May last Committed by Mr. Justice
Grose for want of Bail to answer this Indictment and the said
Defendant continuing in Custody for want of Bail until the last
Session [..]
Order [..] as a Gaol Traver [..]
to proceed thereon and this was advised to and did prepare for the
Tryal of the said Indictment pursuant to a Notice of Tryal given by
the said Defendant for the said last Session And this Deponent
Saith he did for that purpose at very great trouble and Expence Cause
his Witness to be Subpena'd and to attend and his Councel to be Feed
and was in every respect prepared for such Tryal And that on Monday
the Twelfth day of May last being the last day of the said Session and on
which day the said Defendants Tryal was expected to have come on
pursuant to his Notice of Tryal and while this Deponent and his
Witness's were attending this Court in order for such Tryal he was
informed by Mr. Silvester one of his Councel that the said Defendant
having some little time before been charged (or caused himself
to be charged) in Execution on the Middlesex side could not be
brought up to tried on this Indictment (being on the London side)
without a Writ of Habeas Corpus which this Deponent for the reason
aforesaid not being prepared with nor could then get it being Whitsun
Monday the said Defendant could not be tried on the said Indictment [..]
at that Session And this Deponent Saith in expectation that the [..] said
Defendant would give Notice of Tryal for this present Session he did on
Monday the Twenty fourth day of June last cause two Writs of spa
to be if sued out of his Majesty's Court of Kings Bench in Order
to Subpena his Witness's in Support of this Prosecution and did also
direct his Solicitor to Sue out a Writ of Habeas Corpus to bring up the
said Defendant to this Honorable Court to take his Tryal on the said
Indictment and which the Deponent believes was accordingly
