The King agt. Abraham Isaac< no role > on the Prosecution of Anthony Wells< no role >
Case

About the month of July last the Deft. having some words with his Wife
in his own House the prosecutor Stopping at Defendants House & being Curious & Inquisitibe
to know & see whatwhatwas done & what would be the Event & Consequence of what
had happened between the Defendant & his wife the Defendt. happened to last an
Eye & see the prosecutor peeping at his Window & looking in upon him went out to
him & in a Civil manner requested him to go about his Business which the prosecutor
refusing to do the Defendt. might give him a Little push without doing him any
damage whereupon the prosecutor being a man of Courage resented it, & Imediately
Struch the Defendt. & thereupon a Little Skermish Ensued.

Soon after the next day or the day after theDeft.Prosecutor
was in Company with one John Coggan< no role > who works for the Deft. & seem'd
inclinable to Drink with the Deft. in order to Accommodate this little Skirmish
when the Prosecutor then declared that he had been Ill for sometime with a
Violent pain in his Breast on which he were a Plaister & that he wod do the Deft.
that Justice that he had never Struck him on his Breast, for might if he
had been of Bad Consequence, this Depont. did notperformperceive
of that the prosecutor had received any the least damage, nor does this Depont.
believe that he was hurt the Prosecutor not Complaining of any Ill

In July last the Deft. was Served with a Copy of a Bill of Middlesex
at the Plts. Suit ret on the 24th. of this Instant Octr . & the prosecutor has declared that he
never Saw or knew the Deft. or had any Dealing with him before this Small affray &
therefore whether the Deft. shall thus be harrass'd with an Accon in the Court of Kings
Bench & stand Indicted in this Court for one & the Same Offence. should not the
Prosecutor now make his Election in which Court he will proceedr.

Notice has been regularly given to appear & plead Guilty to the
Indictment lately preferr'd by the Prosecutor against the Defendant which Mr. Moore who
Acts as Attorney for the Prosecutor will admit, your Endeavours therefore must be to
Entenuate & Sessen the Fine now to be Insticted on the Defendant.
