Case</p>
<p n="133">About the month of July last the Deft. having some words with his Wife<lb></lb>
in his own House the prosecutor Stopping at Defendants House & being Curious & Inquisitibe<lb></lb>
to know & see what<del>what</del>
was done & what would be the Event & Consequence of what<lb></lb>
had happened between the Defendant & his wife the Defendt. happened to last an<lb></lb>
Eye & see the prosecutor peeping at his Window & looking in upon him went out to<lb></lb>
him & in a Civil manner requested him to go about his Business which the prosecutor<lb></lb>
refusing to do the Defendt. might give him a Little push without doing him any<lb></lb>
damage whereupon the prosecutor being a man of Courage resented it, & Imediately<lb></lb>
Struch the Defendt. & thereupon a Little Skermish Ensued.</p>
<p n="134">Soon after the next day or the day after the<del>Deft.</del>
Prosecutor<lb></lb>
was in Company with one <rs type="persName" id="LMSMPS50389_n134-1">John Coggan</rs>

who works for the Deft. & seem'd<lb></lb>
inclinable to Drink with the Deft. in order to Accommodate this little Skirmish<lb></lb>
when the Prosecutor then declared that he had been Ill for sometime with a<lb></lb>
Violent pain in his Breast on which he were a <rs type="occupation" id="LMSMPS50389_occ52">Plaister</rs>

& that he wod do the Deft.<lb></lb>
that Justice that he had never Struck him on his Breast, for might if he<lb></lb>
had been of Bad Consequence, this Depont. did not<del>perform</del>

of that the prosecutor had received any the least damage, nor does this Depont.<lb></lb>
believe that he was hurt the Prosecutor not Complaining of any Ill<lb></lb>

at the Plts. Suit ret on the <rs type="date" id="LMSMPS50389_date18">24th. of this Instant Octr</rs>

. & the prosecutor has declared that he<lb></lb>
never Saw or knew the Deft. or had any Dealing with him before this Small affray &<lb></lb>
therefore whether the Deft. shall thus be harrass'd with an Accon in the Court of Kings<lb></lb>
Bench & stand Indicted in this Court for one & the Same Offence. should not the<lb></lb>
Prosecutor now make his Election in which Court he will proceedr.</p>
<p n="136">Notice has been regularly given to appear & plead Guilty to the<lb></lb>
Indictment lately preferr'd by the Prosecutor against the Defendant which Mr. Moore who<lb></lb>
Acts as <rs type="occupation" id="LMSMPS50389_occ53">Attorney</rs>
