the Prosecution in this Cause, a Prisoner in
Custody
of the Warden of this Majestys Prison of the Fleet
, maketh Oath,
and saith, that he this Deponent, verily believes that the Defendant James Sibery< no role >
hath made new of such means and Methods with the Deputy Warden
of the Fleet
Prison as to induce him to refuse to permit this Deponent
to go out into the Rules of the said Prison, in order to give Evidence
against the said Deponent, upon this Indictment notwithstanding
this Deponent has given, and entered into, good and sufficient Security
for the Priviledge and Liberty of the Rules of the said Prison which this
Deponent enjoyed, and was suffered to go at large within the said Rules
untill last Night when after the said Defendant had lodged with the
said Deputy Warden a Habeas Corpus, for bringing him up to this
Honorable Court, the said Deputy Wardens then gave Orders that this
Deponent, and the several other Prisoners this Deponents Witnesses,
should not go out side of the said Prison, any more unless the said
Indictment
, against the said Defendant was settled, by which means
and by the Contrivance of the said Defendant, as aforesaid, this Deponent
is prevented from attending, to give Evidence on the Trial of this
Indictment
and this Deponent further saith, that he is not in
ability at present, to pay and defray, the Expences, of a Habeas Corpus
to bring himself and his Witnesses, before this Honorable Court
to give their Evidence at this Session.
