Yr. Neptew Mr. Wilkinson was soe kind to call
on me about my appeale & gave me the for me & desired me
in it to state, the fact, I can draw a conveyance pape
a title or give an opinion in a difficult point of law but
wally was cassled to draw their appeale but cend it to
you inclosed to alter; the fact is this

The Kings High way from Whitton to Twickenham
runs neare ye front of St. Godfrey house just beyond the Road which
fronts the house St Godfrey has a crosse of land and
to her me the Road proposed to bring it crosse this
Closse from the house of Pevey to two Gates mensiond
in the ad quod Damnum in length 203 Yards and
this the ad quod damnum licences him to doe and
this very was crosse his closse 203 Yards long the
Jury on the Inquisition set & marked out with
Stakes & returned it on the inquisition ver ba [..]
as the Licence is in the ad quod Damnum. But
St. Godfrey has set out with pales a way quit different
from that in ye ad quod damnum & inquisition &
has now carried his way quitt round the closse fronting
his house 300 yards in length & by this meanes
the way comes all along the side of my Garden well
soe that What be perpetually annoyd with dast
clnoice. In my opinion were there noe appeal any one might
fling up this way for the statute only makes the Inquisition on
the returne of the ad quod Damnum final where the party
pursues this way mentiond in the ad quod damnum &
Inquisition but if a man will of his owne. head sett
out a way not warranted by the ad quod Damnum
& inquisition He void I beleive St. Godfrey insensible
of this for tho he railed in this way above four
months since yet he has never Stoped up the old
Roead or upend the new one; The Staule ordaines
the ply Mall appeale the next Quart. sessions
at [..] any person is Greived by stoping up the way
But Mr. Wilkinson tells me that in ten Ocessolstew
case the Justices saved his appeale to [..] even
before Inquisition what I have to entreat you is
that you will favor me soe farr as to get my
Right of appeale saved to me that I may contest
this matter when ever St: Godfrey thinks fit to
Stop up the old road I which will very much
oblige St.
