For an Assault

Michael Moran< no role > of Rosernary Lane in the County of
Middlesex Taylor Maketh Oath and Saith That heir
under Bail to take his Tryal at this present Sessions
but the Defendant is not able to got himself ready for
that purpose by reason of not having the Attendance
of Humphrey Tristan Potter< no role > a Material and absolutely
necessary Witness for this Deponent as knowing the
whole of the Affair but who for some time [..] hath
brown Prisoner in the Custody of the Sheriff of the County
of [..] And this Deponent further Saith the True of his
[..] amount this Deponent respected was so fined in
June last but finds on Enquires the said Witnesses
Imprisonment will not be on before the latter End of
this present [..] th of July by which this Deponent
cannot have his [..] And this Deponent further
saith he cannot safely go to Tryal for [..] of this Witnesses
Evidence as the Prosecution is very oppressive and
Malevolent which makes this Deponents Care
exceeding hard for want of such Material Evidence on
his part and the Expense to hath been part to in this Business
And this Deponent saith there one he hopes the Court
will lot his present Bail stand as for his appearing and
taking his Tryal at the next Sessions it bring their desire
as well as their Deponents When this Deponent will come into
Court and take his tryal upon the said Indictment preferred
against him agreeable to Rules of this Court he this Deponents
being unable to remove the said Hump [..] Tris Team
Father from ye New Goal in the Borough of Southsarh and
Sd County of Surry by Habeas to give his Testimony in this
Came on Account of this Deponent's Poverty
