John D' Arcy Cusack of Gloucester Street Queen Square Esquire maketh
Oath and Saith that the Bile of Indictment in the above mentioned Prosecution was
preferred and found against him at the Sessions of the peace held for this county in
the Month of June nowlast past for a supposed Assault committed by this Deponent
on the said William Simpson< no role > the Prosecutor above named on the Seventeenth Day of M [..]
in the Twenty Eighth Year of his present Majesty's Reign which is now nearly Sixteen Months ago
And this Deponent further Saith that he did not either at or hath ever since the Time whan
the said supposed Assaut was committed absented himself in order to clude this
Prosecution And that on Account of the length of time having dapsed since the said
supposed Assault was committed he is advised that he cannot with Safety to himself
put himself on his Trial according to the Condition of his Recognizance by reason of the
Absence of Several Material Witnesses which he is informed are absolutely necessary
for this Deponent to bring preserved and which he will be able to do by the next Sessions of
the Peace to be holden for this County And this deponent also Saith that Gaddons
who Acts as Attorney or Solicitor for the Prosecutor here in hath declared that he is determined to co [..]
this Deponent unless he withdraws an Action he hath commenced against one Walter< no role > also
William Gough< no role > for Assaulting and false imprisoning this Deponent which declaration
induces this Deponent to believe that the said Gaddon means to bring false
Evidence And this Deponent further Saith that proper Notice hath been given to the
Prosecutor that he this Deponent should move this court to respite this Recognizance
given in this Prosecution to the next Sessions
