On the Prosecution of
Johnson for an Assault

George Cocker< no role > of Paradise place near the City
Road in the County of Middlesex Carpenter
Maketh Oath and Saith that he was indicted at
the last Sessions by the above named Johnson
for an Assault which indictment this Deponent
Bailed And this Deponent further saith that
he Attended this Honourable Court on Monday
last the ninth day of September instant being
the First day of the present Sessions in Order
to take his tryal but upon inquiry of Mr Henley
he was informed he should have given four
days Notice of Tryal and be spoke a Venire on
ofSaturday last And this Deponent positively
Saith that he was totally ignorant in what
manner to proceed untill he was informed by
Mr Henley this Deponent concerning that
it was incumbent on the Prosecutor to give
him Notice of Tryal And this Deponent
saith that he is ready and willing to take
his tryal when ever this Honourable Court
shall Order
