For the Wilfull Murder of Thos. Smith
on the 20th. day of April last at the Pish
of St. Paul Shadwell with a certain
Gun charged with Gun powder & leaden
Shot which in both his hand she then had
& held to agt. & upon the sd. Thos. Smith fel
did Shoot & discharge And that the sd.
Thos. Gilbarthop< no role > with the leaden Shot by force of the
Gun powder sent forth upon the head a little
above the left Temple And upon the left
side of the Body of sd. Thos. Smith did
Strike penetrate & Wound giving to
him the said Thos. Smith upon the head
a little above the left Temple one Mortal
Wound breadth 1/10 of an Inch & Depth two
Inches And also upon the left side of the
Body a little below the left Breaston
Mortal Wound Breadth 1/10 of an Inch &
Depth 4 Inches of wch. sd. Mortal Wounds
he then & there Instantly Died

sd. Wm. fel did Strike penetrate & Wound
giving to him the sd. Wm. upon the Top of his
Head on Mortal Wound Depth two Inches
& Breadth one Inch of wch. sd. Mortal Wound
he then and there Instantly Died
